The petitioner apprehends his arrest in Banka (Barahat) P.S. Case No. 922 of 2016 registered for the offence punishable under Section 414 of the Indian Penal Code.

The informant police officer alleged that on three motorcycles many persons were going but after seeing the police two motorcyclists fled away. One Ravi Kumar Rai was apprehended who disclosed that he along with other accused persons were going to commit theft of motorcycle. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot. Nothing has been recovered from possession of the petitioner. The petitioner is accused in another case in which Ravi Kumar Rai confessed his

Patna High Court Cr.Misc. No.26264 of 2017 (2) dt.13-07-2017 2/2 guilt and disclosed the name of the petitioner. The petitioner has got no criminal case except Banka (Barahat) P.S. Case No. 888 of 2016 pending against him.

Considering the facts aforesaid the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 2nd Class, Banka in Banka (Barahat) P.S. Case No. 922 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
