JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Banka (Mahila) P.S. Case No. 41 of 2018 registered for the offences punishable under Sections 498-A, 494, 493, 426, 341, 323, 504/34 of the Indian Penal Code.
Petitioners no. 1 and 2 happen to be parents-in-law of the informant and it is informed that they have already been arrested. Accordingly, their prayer for anticipatory bail stands disposed of being infructuous.
So far as petitioner no. 3, namely, Jitendra Sah @ Jitendra Kumar is concerned, there is no specific allegation
Patna High Court Cr.Misc. No.73283 of 2018(2) dt.20-12-2018 2/2 against him and he is admittedly Devar of the informant. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner no. 3, namely, Jitendra Sah @ Jitendra Kumar, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka in Banka (Mahila) P.S. Case No. 41 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
