JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2017 The petitioner seeks regular bail in connection with Patori (Mohanpur) P.S. Case No. 94 of 2017, registered for offences punishable under Section 364/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner has not been named in the F.I.R, her name transpired in this case during the course of investigation, when the victim boy disclosed her name in his statement recorded under Section 164 Cr.P.C. that she was also assisting other accused persons. It has also been submitted by learned counsel for the petitioner that save and except that she was also assisting other accused persons, there is no active participation of this petitioner in the kidnapping of victim, has been found. Further she is a lady and has six months old child and has been in judicial custody since 10.03.2017. Heard learned A.P.P. also.

Having heard both sides, in view of the facts as stated above, let the petitioner above named, be released on bail on

Patna High Court Cr.Misc. No.25633 of 2017 (3) dt.10-07-2017 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur, in connection with Patori (Mohanpur O.P.) P.S. Case No. 94 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of her bail bonds.
