Petitioner seeks bail in Bhagwanpur hat P.S. Case No. 166 of 2018 registered for the offence punishable under Sections 341, 323, 379, 354, 376, 448, 504, 506 and 511 of the Indian Penal Code.
Informant has alleged that she lives alone with her children and her husband remains outside. Petitioner wanted to establish physical relation with her but she did not agree and on the date of occurrence while she was sleeping with her children, petitioner entered his house and tried to commit rape upon her but on raising alarm he fled away.
It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case due to dispute with the husband of the Informant. Petitioner has got no
Patna High Court Cr.Misc. No.67903 of 2018(2) dt.28-11-2018 2/2 criminal antecedent and is in custody since 12.08.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Bhagwanpur hat P.S. Case No. 166 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
