The petitioner seeks bail in Kaluahi P.S. Case No. 17 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
79 litres of foreign liquor is said to have been recovered and seized from a Xylo vehicle and for that the petitioner was apprehended.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence and he has been falsely implicated in the case. The petitioner happens to be the driver of the vehicle and he has no
Patna High Court Cr.Misc. No.26382 of 2017 (2) dt.13-06-2017 2/2 concern with the seized wine. The petitioner is languishing in custody since 02.03.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Madhubani in connection with Kaluahi P.S. Case No. 17 of 2017.
