The petitioner seeks bail in connection with Balrampur P.S. Case No. 121 of 2016, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is of recovery of 152 bottle, each containing 375 ML and 136 bottle, each containing 180 ML of India made foreign liquor from a vehicle, which was being driven by the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 09.08.2018.

Having regard to the facts and the circumstances of

No.71445 of 2018(2) dt.06-12-2018 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise Act, Katihar in connection with Balrampur P.S. Case No. 121 of 2016.
