====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chakia P.S. Case No. 232 of 2018 instituted for the offence under Section 379 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has been made accused in the instant case merely on suspicion. He has clean antecedent.

It is alleged in the written report that informant had gone to Chakia Block Office from his Apache Motorcycle. The informant after parking his Motorcycle, went inside the Block office. It is further alleged that from window of the office the informant saw one person who was carrying his Motorcycle towards outside. The informant raised hulla and on chase, he was apprehended. He disclosed his name as Jitendra Kumar

As such, from the written report it appears that petitioner has been apprehended on suspicion raised by the informant.

Petitioner is said to be in custody since 13.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 13th, Motihari, in connection with Chakia P.S.
