JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 Petitioner prays for bail in connection with Barachati (Mohanpur) P.S.Case No. 467 of 2018 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation as per FIR is that petitioner and others have taken coal from the informant worth Rs.11,92,000/- and they have not paid the same.
Submission of learned counsel for the petitioner is that he is not partner to the agreement, which is Annexure-2 and that shows that petitioner is not a partner to the agreement, rather he is only a witness and further this case relates to civil dispute and if there is any payment not made the remedy is of money suit and petitioner is in custody for more than three

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail stating that dues are against petitioner and others but they have not paid the same.
Having heard both sides and in the facts and circumstances, as stated above, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, in connection with Barachati (Mohanpur) P.S.Case No. 467 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
