The petitioner seeks bail in connection with Bairiya P. S. Case No. 163 of 2019 dated 27.05.2019 instituted for the offences under Sections 489(A), 489(B), 489(C), 420, 414 and 34 of the Indian Penal Code.

According to the accusation in the F.I.R., a raid was conducted in the house of one Dina Nath Chaudhary on a secret information to the police that the aforesaid Dina Nath Chaudhary along with his associates have assembled at his house for dealing in counterfeit

When the house of the aforesaid Dina Nath Chaudhary was raided, some of the persons sitting there could manage to escape taking advantage of darkness. However, some of the persons available in the house were arrested including the petitioner. From the house of the aforesaid Dina Nath Chaudhary, apart from the counterfeit currency notes, certain other wherewithals for printing counterfeit currency notes were also recovered. One of the accused persons, who was arrested from the house of Dina Nath Chaudhary, namely, Sanjay Ray, is stated to have granted bail by a Bench of this Court vide order dated 04.09.2019 passed in Cr. Misc. No. 55068 of 2019.

There is no recovery from the possession of the petitioner.

It has been submitted that the petitioner had only gone the house of aforesaid Dina Nath Chaudhary on a social visit but as ill luck would have it, he was also arrested at the time of raid.

Patna High Court CR. MISC. No.68002 of 2019(2) dt.04-12-2019 3/3 The petitioner does not have any criminal antecedent and he is in custody since 29.05.2019. Regard being had to the above-stated facts, this petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Bettiah, West Champaran in connection with Bairiya P. S. Case No. 163 of 2019.
