1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 74, 303(2), 352, 351(2) of the B.N.S.

The learned counsel for the petitioners submits that the petitioners have antecedent of two cases and the informant alleges that on 30.05.2025 at 8.00 A.M., the accused persons including the petitioners came on account of previous dispute and started abusing on protest, the accused started assaulting. On alarm, his wife came to save him but Shiv Prasad abused

Patna High Court CR. MISC. No.71252 of 2025(2) dt.10-11-2025 2/3 her, hence she fled inside the house but petitioners dragged her outside and Shiv Shankar started assaulting her by lathi on account of which, bleeding started from her private parts and Harendra snatched her jitiya.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that date of occurrence is 30.05.2025 and the FIR came to be instituted on 15.06.2025 i.e. after a delay of 15 days which casts an aspersion on the case of the prosecution. It is next submitted that though informant in the FIR alleges that his wife still under treatment at PMCH, but then, had the wife of the informant been assaulted in the manner, as alleged leading to injury, in that event, the hospital would have informed the police about the occurrence, but then, the instant FIR has been instituted based on a written application of the informant. It is also submitted that even presuming what has been alleged is true without admitting, then petitioners are not alleged to have assaulted the wife of the informant.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the

No.71252 of 2025(2) dt.10-11-2025 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Samastipur in connection with Sahpur Patori P. S. Case No.254 of 2025, subject to the conditions laid down under Section 438(2) of the BNSS.

7. The application stands allowed.
