JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier prayer bail application of the petitioner was disposed of by this Court vide order dated 6.11.2017 passed in Cr.Misc.No. 41783 of 2017 with direction to trial court to mediate between the parties so that petitioner pays some interim maintenance to his wife and if petitioner is ready to pay any reasonable maintenance amount to his wife either in lump sum or in instalment, the court below will release the petitioner on bail to its own satisfaction.

However, learned counsel for the petitioner submits that he has offered to pay Rs.1000/- per month as maintenance to his wife but she has refused to accept the same and due to that he is in custody since 6.5.2017.

No.74447 of 2018(2) dt.20-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, and considering the period of custody, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Imamganj P.S.Case No. 33 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial, otherwise his bail bond shall be cancelled.
