JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 307, 120B of the Indian Penal Code and Sections 3, 4 of Explosive Substances Act. According to prosecution case itself, at the time of explosion of bomb petitioners were in jail custody in connection with cases lodged by the informant of the present case. The informant claimed in her written report that bombs were exploded in pursuance of conspiracy hatched up by the petitioners as well as other accused.

Patna High Court CR. MISC. No.66177 of 2019(2) dt.22-10-2019 2/2 Submission on behalf of the petitioners is that there was land dispute between informant and petitioners and petitioners have already been granted privilege of bail in the above stated two cases which had been lodged by the informant against the petitioners. It is further contended that except the above stated cases as well as present one, petitioners do not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioners are in jail custody since 10.07.2019, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Tatarpur P.S. Case No. 154 of 2019.
