JUSTICE SANJAY PRIYA ORAL ORDER 3/ 26-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Babubarhi P.S. Case No.26 of 2017 instituted for the offence under Section(s) 401 Indian Penal Code.

It has been submitted that the petitioner has clean antecedents. He has been apprehended merely on suspicion. No money has been recovered from his possession. As per written report, the informant went to purchase the goods in the market then a boy picked up `12,500/- from his pocket. On chase made by the informant and other persons, the petitioner was apprehended. From the written report itself, it appears that nothing has been recovered from his possession although it is alleged that the petitioner was arrested on the spot.

Patna High Court Cr.Misc. No.26679 of 2017 (3) dt.26-07-2017 2/2 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Madhubani, in connection with Babubarhi P.S. Case No.26 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
