2. Despite filing appearance, the opposite party is not present on call though the names of host of lawyers is their on the cause list.
3. The present petition has been preferred for transfer of the Matrimonial Case No. 608 of 2023 filed under section 13 of the Hindu Marriage Act, 1956 by Shashank Priyadarshi (Opposite Party) from the Court of Principal Judge, Family Court, Patna to Principal Judge, Family Court, Begusarai.
4. Learned counsel for the petitioner submits that she along with her female child are suffering and due to the threat made by the husband, she always feel inconvenient in the capital city. She is further facing financial problem in
Patna High Court MJC No.2964 of 2023(4) dt.29-08-2024 2/2 maintaining herself as also her child and in that background, it may not be possible for her to come to Patna, presently stationed at Muzaffarpur.
5. As stated above, despite filing appearance, the learned lawyer concerned chose not to present the case of the husband.
6. In that background, this Court is inclined to allow the prayer, let the files of Matrimonial Case No. 608 of 2023 presently pending before the court of learned Principal Judge, Family Court, Patna be transferred to the court of learned Principal Judge, Family Court, Begusarai.
7. The husband, as also the petitioner will have the liberty to appear before the Court either physically or through virtual mode.
