====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Marhaura P.S. Case No. 438 of 2018 instituted for the offence under Sections 25(1-b)a and 26 of Arms Act.
The prosecution cases hinges on self statement of the informant Ram Das Rai of Masaurha Police Station recorded by himself stating therein that he after getting information that some notorious miscreants namely, Satyendra Nut and Rakesh Nut have stayed at his house, he proceeded along with other police party and reached at new market Olhanpur Chowk. Raid was conducted by them, but the accused persons on seeing the police party tried to run away. They were caught hold by them. Both disclosed their name as Satyendra Nut and Rakesh Nut (petitioner). The police on search, recovered one country made
Patna High Court Cr.Misc. No.72037 of 2018(2) dt.05-12-2018 2/2 pistol and live cartridges from possession of Satyendra Nut and one loaded country made pistol along with live cartridge from possession of this petitioner.
Counsel for the petitioner submits that petitioner is in custody since 10.9.2018 having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Saran at Chapra, in connection with Marhaura P.S.
