2. The petitioner seeks regular bail in connection with Sour Bazar P.S. Case No. 812 of 2023 for the offences registered under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.

3. As per the prosecution case, husband of the informant was shot dead by unknown person.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. F.I.R. has been lodged against unknown person, however during course of investigation on the basis of confessional statement of the petitioner that she had instigated her husband to

Patna High Court CR. MISC. No.74372 of 2024(3) dt.18-12-2024 2/2 commit suicide, she has been made accused in this case. She is in judicial custody since 25.12.2023. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Saharsa in connection with Sour Bazar P.S. Case No. 812 of 2023.
