The petitioner is in custody in connection with Sitamarhi P.S. Case No. 375 of 2016 for the offences under Sections 393, 34, 395 and 412 of the Indian Penal Code. The FIR was lodged against known. The name of the petitioner surfaced in this case on the confessional statement of the co-accused. Since the case was registered against unknown, the petitioner was not put on Test Identification Parade despite the fact that he is in custody since 17.11.2016.
It appears from Annexure-2 series that coaccused Narendra Singh was granted bail by a coordinate Bench of this Court in Cr. Misc. No. 7246 of 2017 vide order dated
Patna High Court Cr.Misc. No.27606 of 2017 (2) dt.06-07-2017 2/2 4.4.2017 and co-accused Suraj Kumar in Cr. Misc. No. 7460 of 2017 vide order dated 17.4.2017.
Submission of learned counsel for the petitioner is that the case of the petitioner is similar to that of the co-accused who have been granted bail by this Court by orders as contained in Annexure-2 series.
Having regard to the fact that the FIR was lodged against unknown, despite arrest of the petitioner on 17.11.2016 he was not put on Test Identification Parade and the fact that other co-accused have been granted bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi or the successor Court in connection with Sitamarhi P.S. Case No. 375 of 2016, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
