The petitioner apprehends his arrest in connection with Paraiya P.S. Case No. 14 of 2019, registered under Section 409/34 of the Indian Penal Code.
The accusation is of non submitting of records regarding Panchayat Teachers by six Panchayat Secretaries including the petitioner, Ram Chhapit Prasad, being Panchayat Secretary of Gram Panchayat, Karhara.
Learned counsel for the petitioner submits that, in fact, petitioner was holding the post of Jan Sevak in block Paraya under which, village Karhara is also situated but the petitioner has also been implicated in the present case in the
Patna High Court CR. MISC. No.64371 of 2019(2) dt.04-11-2019 2/2 capacity of the then Panchayat Secretary, Karhara, while he was retired on 31.01.2003 from the post of Jan Sevak and he is receiving pension for the post of Jan Sevak not the post of Panchayat Secretary.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Gaya, in connection with Paraiya P.S. Case No. 14 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
