2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Complaint Case No. 2758 of 2019, dated 16.11.2019 registered for the offence punishable u/ss 420, 323, 341 and 504 of the Indian Penal Code.

4. As per the prosecution case, the petitioner along with the co-accused person are alleged to have taken Rs.

Patna High Court CR. MISC. No.73553 of 2023(2) dt.29-11-2023 2/3 25,000/- under the scheme of 'Sahara India' from the complainant without giving any bond/ receipt and they also disappeared. It is further alleged that when the complainant asked the petitioner to return the money then the petitioner along with the other accused persons assaulted her, made her half nude and snatched her golden chain.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is further submitted that there is an admitted land dispute between the parties. It is further submitted that the complainant and the petitioner are close family members. The complainant being the wife of petitioner's brother is residing together. It is further submitted that the petitioner is the agent of 'Sahara India Credit Bank'. Learned counsel has further submitted that the complainant has not produced any document to prove that she has given any amount to the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be

No.73553 of 2023(2) dt.29-11-2023 3/3 enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Araria in connection with Complaint Case No. 2758 of 2019, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
