The petitioner is in custody in connection with Chausa P.S. Case No. 76 of 2017 registered for the offences punishable under sections 414 and 420 of the Indian Penal Code. The allegation against the petitioner is that he is involved in sale of the stolen bike.

It has been submitted on behalf of the petitioner that he is a mechanic and he was called by the owner of the motor cycle and he is not in any way connected with the sale of the stolen motor cycle and there is statement on oath in paragraph 3 of this petition that the petitioner has no criminal history. The petitioner in paragraph 6 of this petition has claimed that he is a

Patna High Court Cr.Misc. No.26986 of 2017 (3) dt.06-07-2017 2/2 mechanic and runs a garage to repair the motor cycle at Chausa. In the facts and circumstances mentioned above and considering the fact that the petitioner is in custody since 27.3.2017, I am inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Uddakishunganj, District-Madhepura/ Successor Court in connection with Chausa P.S. Case No. 76 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
