JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 The petitioners seek regular bail in connection with Pupri P.S. Case No. 87 of 2013, registered for offences punishable under Sections 147, 148, 149, 333, 337, 338, 307, 427 and 453 of the Indian Penal Code.
Allegation against the petitioners and others is of disturbing the communal harmony.
It has been submitted on behalf of the petitioners that earlier they were granted anticipatory bail by a coordinate Bench of this Court, however, they could not know about the same and could not surrender in time for furnishing bail bonds and later on they were declared absconder. Now the petitioners
Patna High Court Cr.Misc. No.68560 of 2018(2) dt.30-11-2018 2/2 have surrendered and they are in custody. Further submission is that one of the co-accused persons having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 16.08.2018 passed in Cr. Misc. No. 47414 of 2018.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Pupri P.S. Case No. 87 of 2013, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
