JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Learned counsel for the petitioner is permitted to make necessary correction in paragraph -1 of the petition. The petitioner seeks regular bail in connection with Chausa P.S. Case No. 225/2018, registered for offences punishable under Sections 147, 341, 323, 307, 120(B), 504 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that while the informant, his brother and some villagers were returning after having feast, accused persons including the petitioner surrounded them and, thereafter, petitioner ordered to kill the informant, on which, co -accused Barun Mandal fired, which hit left side of chest. However, the informant and other villagers tried to flee away but the petitioner and other accused persons caught hold the

Patna High Court Cr.Misc. No.71614 of 2018(2) dt.12-12-2018 2/2 informant and co-accused Pintu Mandal fired on him, which hit him into his back, co-accused Pramod Mandal fired on him causing injury to the informant on his temporal region, thereafter the informant fell down.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and from the F.I.R. itself it is evident that the petitioner is not the assailant. Further he has no criminal antecedent and has been in judicial custody since 30.08.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj (Madhepura), in connection with Chausa P.S. Case No. 225/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
