2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 351(2), 352, 303(2), 3/5 of the Bharatiya Nyaya Sanhita.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent.

4. The learned counsel for the petitioners after arguing vehemently for some time realizing his difficulty, seeks permission to withdraw the anticipatory bail application with

Patna High Court CR. MISC. No.72194 of 2025(2) dt.11-11-2025 2/3 respect to petitioner nos. 3 & 4 i.e. Manish Kumar & Aman Kumar respectively.

5. Permission is accorded.

6. It is next submitted that the informant alleges that his son was laying soil on his tractor for delivering to Arvind when accused persons came along with 10-12 unknown accused and started abusing and on protest Sandeep threatened with gun while Sanjay snatched his chain worth Rs. 80,000-90,000/- and Manish, Aman along with Pawan assaulted his son by Farsa causing injury on left eye, thereafter, all the accused assaulted him by lathi and danda, on alarm villagers came and saved his son.

The learned counsel appearing on behalf of the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that allegation against Sandeep and Sanjay is ornamental in nature. It is next submitted that Sandeep is alleged to have threatened with gun but then the F.I.R. has not been instituted under the Arms Act and Sanjay is alleged to have snatched chain worth Rs. 80,000-90,000/- which is ornamental in nature. It is further submitted that there is no specific allegation of assault alleged against the petitioner nos. 1 & 2.

8. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

9. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chakiya P.S. Case No. 192 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
