The petitioner seeks bail in Begusarai Town P.S. Case No. 579 of 2016 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner is not named in the FIR. The spy of the police in paragraph-51 of the case diary disclosed the name of the petitioner and thereafter the petitioner is said to have confessed his guilt before the police.

Learned counsel for the petitioner submits that save and except confession that too before the police, there is no other material to show the involvement of the petitioner in the alleged crime of murder. Similary situated co-accused Anand Mohan @ Bhulla has already been enlarged on bail vide order dated

Patna High Court Cr.Misc. No.28623 of 2017 (2) dt.10-07-2017 2/2 03.07.2017 passed in Cr. Misc. No. 18385 of 2017 by a coordinate Bench of this Court.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in Begusarai Town P.S.
