2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148 , 149, 341 , 342, 332, 337, 338 , 307, 427, 504 and 506 of the Indian Penal Code.
3. As per FIR, 4 named and 100 unknown persons including this petitioner tried to kill the accused who was in police custody and hindered the public servant in discharging their duties.
4. It is submitted that petitioner is not named in the F.I.R., and allegation is vague and omnibus. It is further submitted that the persons who are named in the F.I.R., have already been granted bail by the Co-ordinate Bench of this Honourable Court vide order dated 07.02.2023 in Cr. Misc .
Patna High Court CR. MISC. No.71524 of 2023(2) dt.09-11-2023 2/2 No. 1368 of 2023 . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VI Patna city in connection with Bypass P.S. case No. 267 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
