The petitioner in the present case is seeking regular bail in connection with Arwal P.S. Case No. 23 of 2017, registered for offence alleged under Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he was selling a stolen motorcycle to one Vijay Paswan. Learned counsel submits that the recovery has been made from the house of Vijay Paswan, who had disclosed that the motorcycle belongs to this petitioner, however, the allegation is that this petitioner could not produce any paper in respect of the said motorcycle. Learned counsel submits that save and except that there is no other prima facie evidence against him.

Learned A.P.P. opposed the prayer for bail.

Considering the facts and circumstances that the petitioner has no criminal antecedent, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, namely, Nirbhay Kumar be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashok Raj, learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 23 of 2017, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Dilip, AR U T
