====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 14-07-2025 No one appears on behalf of the petitioners. However, learned Additional Public Prosecutor for the State and learned counsel for the opposite party no. 2 are present.
2. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 120(B), 147, 148, 149, 420, 467, 468, 384 of the Indian Penal Code. .
3. Although no one has been appearing for the petitioner in this case from the past several dates but since a
Patna High Court CR. MISC. No.73349 of 2024(7) dt.14-07-2025 2/3 settlement has been reached between the parties, it would be in the interest of justice that the matter still be taken up even in the absence of the learned counsel for the petitioners.
4. The memorandum of agreement dated 10.04.2025 passed in Mediation Proceeding No. 179 of 2025 entered into by the parties to the proceedings at the Patna High Court Mediation Centre would disclose that the parties had settled the matter upon an offer by the petitioners to pay an amount of Rs. 8,00,000/- as full and final settlement amount to the opposite party no. 2 in 8 equal installments. The petitioners as on date has already paid three installments for the months of May, June and July being a total amount of Rs. 3,00,000/- out of Rs. 8,00,000/-. Since, the payment is still being made to the opposite party no. 2, it appears that the petitioners are abiding by the terms of the settlement arrived at the mediation centre.

In such view of the matter, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on provisional bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand)each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with
Patna High Court CR. MISC. No.73349 of 2024(7) dt.14-07-2025 3/3 Bettiah Muffasil P.S. Case No. 303 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
6. It is expected that the petitioners would keep on paying the rest of the amount as per the schedule agreed between the parties. Upon final payment of rest of the amount and showing the proof thereof, the learned court concerned would confirm the provisional bail granted to the petitioners.
7. It is also expected that the opposite party no. 2 would also adhere to the condition of withdrawal of the criminal case upon the entire payment having been made.
