2. The petitioner apprehends his arrest in connection with Sakri P.S. Case No. 138 of 2025 registered for the offences under Sections 274 and 275 of the B.N.S. 2023 and Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution story, on 27.07.2025, at around 2:30 a.m., while patrolling on NH-27 near Anand Dharam Kota Mor, the informant received information that two individuals, Sonu Singh and Shravan Singh of Narpatinagar, were engaged in large-scale illegal liquor trading. Shravan Singh was reportedly transporting a large liquor consignment by truck and unloading it near Mumbai Auto Garage, Village

Due to the late hour, independent local witnesses could not be found, so two constables from the raiding team acted as witnesses. During the raid, 2460 bottles of foreign liquor (891.36 litres) were seized, along with the truck bearing registration BR-02W-8087. The accused in the case are Sonu Singh and Shravan Singh, along with the truck owner and other unknown individuals involved in the illegal liquor trade.

4. Learned counsel for the petitioner submits that the seized articles have been recovered from a six wheeler truck bearing Reg. No. BR-02W-8087 and the petitioner is in no way connected either with the said truck where the said recovery is made or the recovered articles belongs to the petitioner. Learned counsel further submits that he has falsely been implicated in the present case and merely on the basis of secret / confidential information, this petitioner is said to have been made accused in the case and the petitioner has no criminal antecedent.

5. Learned APP for the State opposes the prayer for anticipatory bail application.

6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or

Patna High Court CR. MISC. No.69038 of 2025(2) dt.08-10-2025 3/3 premises belonging to the petitioner and the petitioner has clean antecedent, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.

7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Act, Madhubani, in connection with Sakri P.S. Case No. 138 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023.
