The petitioner seeks bail in Sasaram (T) P.S. Case No. 1114 of 2018 instituted for the offence under Section 376 of the Indian Penal Code.

Counsel for the petitioner submits that informant is married lady having one son. The informant has alleged that she was married with Ravi Shankar Pandey in the year 2002, but her husband has left her in the year 2005. She is living alone with her son namely Pritam Pandey aged about 14 years. It is further alleged that one year prior to lodging First Information Report this petitioner met the informant and gave proposal to perform marriage with her. Thereafter, both of them were talking with each other and also have made physical

Patna High Court Cr.Misc. No.72060 of 2018(2) dt.05-12-2018 2/2 relationship. The informant also alleged that petitioner is not ready to perform marriage with her.

From the narration in the First Information Report, it appears that the informant is married lady and entire act is done with her consent.

Petitioner is in custody since 17.8.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection withSasaram (T) P.S.
