JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 272, 273/34 of the Indian Penal Code and Sections 27 (b) 28 Drugs 7 Cosmetics Act and Sections 22 (B) of the N.D.P.S. Act and Sections 30, 38 of the Bihar Prohibition and Excise Act, 2016.
Allegation in brief is that the Drug Inspector found 160 bottles of cough syrup loaded on a Tempo and it was being shifted in a Santro Car and the Tempo driver disclosed that the seized drugs belongs to the petitioner.
Learned counsel appearing on behalf of the petitioner submits that there is no recovery from the possession of the petitioner. He is not owner of either Tempo or the Santro Car.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Md. Salique @ Salique Azam be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, Araria in connection with Araria (R.S.) P.S. Case No.835 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
