Petitioner is seeking anticipatory bail in connection with Panjawara P.S. Case No.72 of 2018 registered for the offences punishable under Sections 147, 149, 224, 225, 323, 332, 333, 353, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that even though it is alleged against the present petitioner that he was one among the members of the mob who had assembled and had attacked the police party but neither there is any source of identification of this petitioner disclosed in the F.I.R nor any injury has been caused to any of the member of the police force. It is submitted that when the police party had gone to raid the house of the accused some of the villagers have been falsely implicated.
Patna High Court Cr.Misc. No.74808 of 2018(2) dt.21-12-2018 2/2 Learned APP for the State is present and has opposed the prayer for bail.
In the given facts and circumstances where it is the submission of the learned counsel for the petitioner that there was no specific allegation against this petitioner, the petitioner has no criminal antecedent and then there is no source of identification of the petitioner, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judical Magistrate-1, Banka in connection with Panjawara P.S. Case No.72 of 2018 Subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) r.r.ojha/- U T
