ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Chanpatiya P.S. Case No. 131 of 2016 for the offences registered under Sections 366, 457, 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation as made out by the informant is wholly frivolous. The victim lady in her statement under section 164 Cr.P.C. has clearly stated that the petitioner had given her shelter when she was thrown out from her husband's (informant's) house. There is no statement that she was taken away by the petitioner.

Patna High Court Cr.Misc. No.27508 of 2017 (2) dt.13-07-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., vth Bettiah in connection with Chanpatiya P.S. Case No. 131 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
