Petitioner seeks bail in Khaira P.S. Case No.344 of 2018 instituted for the offence under Section(s) 448, 346, 376, 354 (c) (d), 506/34 Indian Penal Code and Sections 4, 7, 8, 11 of the POCSO Act.

There is specific allegation against co-accused, Bhindi Manjhi, of forcibly taking away the informant towards river and committing illegal act with her at the point of knife. It is further alleged that the informant learnt that this petitioner had earlier removed Salwar of her cousin sister and when she raised alarm, he fled away.

Counsel for the petitioner has submitted that no case was earlier filed by the cousin sister of informant against the

Patna High Court Cr.Misc. No.72598 of 2018(2) dt.06-12-2018 2/2 petitioner.

Petitioner is in custody since 03.09.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st Jamui, in connection with Khaira P.S. Case No.344 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
