JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 Petitioner prays for bail in connection with Bhagwanpur Bazar P.S.Case No. 336 of 2018 registered for the offences punishable under Sections 399. 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country-made pistol, 5 cartridges, one magazine, two mobile phones and one motorcycle from his possession and it further appears that he is accused in eight other cases. Submission of learned counsel for the petitioner is that allegation for the offences under Sections 399 and 402 IPC is not made out in this case and petitioner has falsely been implicated in this case and he is in custody for more that four months.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.

With the above observation, this application is dismissed.
