JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioners seek regular bail in connection with Dumariya Ghat P.S. Case No. 147 of 2018, registered for offences punishable under Sections 467, 468, 471, 420 and 414 of th Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Allegation is that truck of the petitioners was intercepted without having number plate on that and on search from the truck 1.875 litres of liquor has been recovered. It has been submitted on behalf of the petitioners that allegations that the truck of the petitioners' was without number plate as well as the allegation of recovery of liquor are
Patna High Court Cr.Misc. No.73515 of 2018(2) dt.14-12-2018 2/2 false and concocted. Further submission is that they have no criminal antecedents and have been in judicial custody since 03.09.2018.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran at Motihari, in connection with Dumariya Ghat P.S. Case No. 147 of 2018, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
