====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 27-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner is apprehending his arrest in connection with Ramgarh Chowk P.S. Case No. 145 of 2025 registered for the offences punishable under sections 25(1-B)a, 27 and 25(a) of the Arms Act.
3. As per prosecution case, on 04.08.2025 at about 16:50 p.m, the police received a video clip showing around 1820 persons celebrating a birthday party on an unidentified vehicle. In the said video, the participants were seen using abusive language and instigating each other to fire. One round of firing was allegedly made during the celebration, after which the group continued dancing. The person appearing to be the main celebrant was seen holding a country-made pistol and

Upon receiving this information, the S.H.O. proceeded with armed force to the residence of Manish Kumar (petitioner) for verification. His family members confirmed that the person seen in the video was their son Manish Kumar and identified another person present as Satyam Kumar. Subsequent discreet inquiry revealed that Satyam Kumar, also visible in the viral video, is known to be criminal-minded and has multiple cases registered against him at Tetarhat Police Station. In view of the unlawful display of firearms, celebratory firing, and participation of individuals with a criminal background, the present case was instituted.
4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence as alleged in the F.I.R. Nothing has been recovered from the conscious possession of the petitioner. It is respectfully submitted that the petitioner has been implicated solely on the basis of the confessional statement of co-accused Satyam Kumar and the confessional statement of co-accused, in law, has no evidentiary value. It is next submitted that the petitioner did not fire; rather, the firing was done by some unknown persons. Neither the vehicle in question nor any arms belong to the
Patna High Court CR. MISC. No.69183 of 2025(4) dt.27-11-2025 3/3 petitioner. It is further submitted that the alleged occurrence is not supported by any independent witness. Petitioner bear no criminal antecedent.
5. The learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Ramgarh Chowk P.S. Case No. 145 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.
