JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody for offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Country-made liquor was allegedly recovered from a vehicle and the petitioners, who were apprehended while they were attempted to flee away.

Submission is that petitioners are in custody since 10.03.2017 and have got no criminal antecedent. Considering the nature of allegation and the period already undergone by the petitioners, let petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 20,000/-

Patna High Court Cr.Misc. No.28204 of 2017 (2) dt.03-07-2017 2/2 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIV, Banka, in connection with Dhankund P.S. Case No. 11 of 2017, with condition that petitioners shall file undertaking at the time of furnishing of the bail-bond before the Court-below that they would not indulge themselves in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
