The petitioners seek regular bail in connection with Tikapatti P.S.Case no.132 of 2018 registered for offences punishable under Sections 147, 148, 149, 152, 341, 342, 332, 333, 353, 427, 504 and 506 of the Indian Penal Code. Allegation against the petitioners and several other accused persons is that they caught hold the Prem Jaiswal and assaulting him and taking him inside the police station. They also damaged the vehicle parked there and abused the police personnel and when one police tried to save Prem Jaiswal they also made scuffle with him.
Submission of the learned counsel for the petitioners is
Patna High Court Cr.Misc. No.73548 of 2018(2) dt.14-12-2018 2/2 that there is general and omnibus allegation against the petitioners and injuries are simple in nature, which will appear from Annexure -2 of the petition and petitioners are in custody since 4.9.2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri D. Prakash, J.M., Purnea in connection with Tikapatti P.S.Case No.132 of 2018.
With the aforesaid observation, this application is allowed.
