JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Nanpur P.S. Case No.19 of 2015 registered under Sections 363, 364 and 372 of the Indian Penal Code.
Allegation is that informant's sister became traceless and did not return from school.
Learned counsel for the petitioners submits that the First Information Report is against unknown and the girl in her statement under Section 164 Cr.P.C. has levelled allegation against Zarina and Shahida. Only allegation against petitioner no.1 is that he had purchased a railway ticket and was waiting at the railway station.
Patna High Court Cr.Misc. No.29179 of 2017 (2) dt.13-07-2017 2 / 2 However, the statement of the girl shows that the petitioners were present at the railway station and brought her to Ludhiana, kept in confinement where Shahid used to make sexual relationship with her.
Having considered the said facts and circumstances, prayer for anticipatory bail on behalf of the petitioners is rejected in connection with Nanpur P.S. Case No.19 of 2015, pending in the court of the learned S.D.J.M., Pupri at Sitamarhi. However, if the petitioners surrender and seek regular bail, the same shall be considered on merit.
