====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 379 and 414 of the IPC. The prosecution story, in brief, is that on 24.04.2019 at about 18.05 P.M. in the evening, the informant caught Amit Kumar and Vickky Kumar with a Tractor. Later on, he came to know that Ravi Kumar (petitioner), Shivu Gope and Bochhi Gope are also involved in the gang.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 21.07.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present

Patna High Court CR. MISC. No.67331 of 2019(2) dt.22-10-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. The name of the petitioner has come in the present case on the basis of secret information as per the F.I.R. The source of secret information has not been disclosed by the prosecution. There is no recovery of incriminating article from possession of the petitioner. The petitioner has not been put on T.I. Parade.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Hilsa, Nalanda, in connection with Karai Parsurai P.S. Case No. 62/2019.
