The petitioner apprehends his arrest in Vaishali P.S. Case No. 106 of 2017 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. The informant alleged that her minor daughter became traceless. During course of search, she came to know that Saroj Kumar, Rohit Kumar and Vinod Kumar kidnapped her minor daughter. Upendra Sahni and Nandlal Sahni are alleged to have helped them in kidnapping of the minor daughter of the informant.

Learned counsel for the petitioner submits that the informant is not an eye witness of the occurrence. The victim has already been recovered. The victim disclosed that Saroj Kumar,

Patna High Court Cr.Misc. No.29082 of 2017 (3) dt.19-08-2017 Rohit Kumar and Vinod Kumar kidnapped her and kept in the house of their relatives. The victim did not name the petitioner. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali P.S. Case No. 106 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
