Petitioner seeks bail in a case registered under Sections 302, 120B, 506/34 of Indian Penal Code and Section 27 of Arms Act.

It is submitted by the petitioner's counsel that the allegation of firing is attributed against co-accused Jai Shankar Chaudhary and Abhay Kumar. On the basis of confessional statement of said Jai Shankar Chaudhary, petitioner has been implicated in this case falsely. Prior to the instant case, there is no criminal antecedent of the petitioner and that other two coaccused Ranjeet Kumar @ Ranjet Kumar and Kundan Kumar @ Kundan Sahni, implicated in similar manner, have been allowed

Patna High Court Cr.Misc. No.75844 of 2018(2) dt.17-12-2018 2/2 anticipatory bail by this Court in Cr Misc No 64351 of 2018 and Cr Misc No 66710 of 2018.

Considering the aforesaid submissions and the facts and circumstances of the case, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XI, Vaishali at Hajipur in Jandaha Police Station Case No 202 of 2018 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
