This application, for grant of anticipatory bail, arises out of Baikunthpur Police Station Case No. 99 of 2016, disclosing offences under Sections 302, 201 and 498A of the Indian Penal Code.

Learned counsel for the petitioner has submitted that earlier the prayer for anticipatory bail has been rejected by this Court vide order dated 10.02.2017 passed in Cr. Misc. No. 54112 of 2016 in view of the fact that charge sheet against the petitioner has been submitted. Learned counsel for the petitioners further submitted that no charge sheet in this case has been submitted against the petitioner, therefore, a fresh ground

Patna High Court Cr.Misc. No.30258 of 2017 (7) dt.13-12-2017 arises for consideration of second anticipatory bail application of this petitioner. Hence, the petitioner may be granted privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur Police Station Case No. 99 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
