Mr.Raj Ballabh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 567 of 2018, disclosing offence under Section 498A of IPC.

Petitioner no.1 happens to be the husband of the complainant and there is allegation of assault by the accused persons including the petitioner to the complainant and ousting her from the house. It is also alleged that when petitioner and his father has gone for Bidai of the complainant, they have also assaulted the complainant.

Submission of the learned counsel for the petitioner is that as a matter of fact, he is still ready to keep her with dignity and care, but it is the complainant who is not ready to reside

Having heard both sides and perused the impugned order, from which, it appears that before the court below effort for reconciliation was made, but the wife of the petitioner appeared and stated that it is not possible for her to reside with the petitioner, as she is being assaulted by the petitioner, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Miss Swati Singh, learned Judicial Magistrate, 1st Class, Gaya, in connection with Complaint Case No. 567 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
