JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioners seek bail in connection with Tr. No. 2230 of 2018 arising out of Mirganj P.S. Case No. 26 of 2018 registered under Sections 25(1-b),26 and 27 of the Arms Act. Earlier prayer of bail of the petitioners was rejected vide order dated 03.10.2018 passed in Cr. Misc. No. 49358 of 2018 with observation to renew prayer of bail after framing of charge. The allegation of recovery of loaded country made pistol with live cartridges from the possessions of the petitioners. Submission of learned counsel for the petitioners is that earlier charge has already been framed at that point of time on 07.07.2018 but due to mistake, he could not point out the same. Now, they have remained in custody for more than ten months and are ready to abide by any terms and conditions imposed upon them.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-XVI, Gopalganj in connection with Tr. No. 2230 of 2018 arising out of Mirganj P.S. Case No. 26 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned. The petitioners shall co-operate in disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
