2. The petitioner is apprehending his arrest in connection with Kamtaul P.S. Case No. 258 of 2022 dated 25.10.2022, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act pending in the Court of learned Special Judge-1, (Exclusive Excise Act), Darbhanga.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.78119 of 2023(2) dt.01-12-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
