In this case, the petitioners are apprehending their arrest in connection with Mohania P.S. Case No. 148 of 2017 registered for offences under sections 323, 341, 307, 354(A)(1), 504/34 of the Indian Penal Code.
An allegation has been made that the accused persons came with lethal arms, Lalan Singh, Kundan Singh and Damodar Singh resorted to firing upon her husband and father-in-law with an intent to kill him but it was a narrow escape. Further allegation has been made that Daya Shankar Singh entered into the female
Patna High Court Cr.Misc. No.30469 of 2017 (3) dt.20-07-2017 building and abused, her Gotani tried to shut the door then Jay Govind Singh and Saya Shankar Singh attacked upon her Gotani with Khanti but it was narrow escape, whereupon, the accused persons tied with Gamcha on her neck to kill but somehow the Informant could saved her life.
From the First Information Report, it appears that none of the persons received any injury though it has been alleged that there was a firing and the persons have tried to assault with Khanti but it also did not hit the Gotni, the Informant. Looking to the entire facts and circumstances of the case, let the petitioners, namely, Lallan Singh, Kundan Singh, Bajrang Singh, Damodar Singh, Daya Shankar Singh and Jay Govind Singh in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 148 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
