2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 115(2), 126(2), 303(2), 351(2), 352 and 76 of the B.N.S.

3 . The prosecution case, in brief, is that on the alleged date and time of occurrence, this petitioner in drunken stage entered informant's room and misbehaved with his wife. On protest, petitioner along with other accused persons assaulted the informant and his wife and on the point of gun, snatched jewellery.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. As a matter of fact, both the parties are neighbours and due to

No.69073 of 2025(2) dt.07-10-2025 2/2 some petty dispute, verbal quarrel took place between them and taking advantage of the situation, this false and concocted case has been lodged. Allegation against the petitioner is general and omnibus. FIR has been lodged after delay of one day and there is no explanation for the same which creates serious doubt on the entire prosecution case. Petitioner claims clean antecedent.

5. Learned counsel for the State opposed the bail petition.

Considering the backdrop of the case, clean antecedent of the petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Gaya in connection with Magadh Medical College P.S. Case No. 145 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
