JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Kotwali P.S. Case No. 375 of 2016 registered for the offence punishable under sections 384, 385 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner never demanded any Rangdari. As a matter of fact, petitioner had objected the informant from blocking the road by dumping sand, bricks and other constructions materials on account of which some altercation had taken place due to which the present false case has been lodged. The present first information report has been lodged after delay of about one and half day without any explanation. Nothing incriminating has been recovered from the petitioner. Petitioner has clean antecedent.

No.28811 of 2017(4) dt.14-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kotwaqli P.S. Case No. 375 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
