JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 The petitioner seeks bail in connection with Trial No. 09 of 2018 arising out of DRI Case No. 03 of 2016 registered under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act.
Allegation against the petitioner is of recovery of more than 200 Kg Ganja from a specially built cavity inside the truck. Submission of learned counsel for the petitioner is that petitioner is only cleaner of the truck and he was not knowing about the same and petitioner is in custody since 04.09.2016. Heard learned counsel for the Central Government also who has opposed the prayer of bail on the ground that the petitioner has confessed his guilt that Ganja was kept concealed in the truck and that clearly shows that he had knowledge about the same.
Patna High Court Cr.Misc. No.74768 of 2018(2) dt.18-12-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. (Vinod Kumar Sinha, J) sujit/- U T
